Registration and bidding
How do I bid on one of the items in the auction?
A. It’s simple. Click on our auction link and it will take you to our auction page. Click the REGISTER button at the top of the page and follow the simple prompts.
Do I need to submit a deposit on the item I’m bidding on?
A. No. You don’t need to put a deposit down on the boat you are bidding on. At the end of the auction if you have won the bid we will contact you for a 10% deposit due within 2 days from the close of the auction.
Can I see the boat before or during the auction?
A. Yes, Call the telephone number for the representative listed within the lot and they will arrange a showing. .
Can I get the boat surveyed?
A. Yes, at the close of the auction if you are the winning bidder. See TERMS AND CONDITIONS page for other details
You’ve won the bid!
What do I do at the end of the auction?
You will be contacted by Brewer Yacht Sales if you are the winning bidder the day the auction ends. A 10% deposit is due within two days of the close of the auction. A Yacht Purchase and Sale agreement will be sent to you to sign. In that agreement you can have the boat surveyed and secure financing within a certain amount of time. The representative listed in the description of the boat will walk you through the very simple process.
How do I know if I have won the auction?
A. We will contact you by phone and email the day the auction closes.
If I win the auction, what if I want some work done to the boat?
A. We can arrange for any work you need done at any of the Brewer Yacht Yards in New England or you can do the work yourself.
When do I have to move the boat?
A. Once the boat has been paid for unless arrangements have been made with the existing marina/yard for winter or summer storage. Boats within a Brewer marina have an existing contract and slip availability or storage is to be negotiated with the marina. The representative listed on the lot can answer additional questions.
Does Brewer Yacht Sales offer financing on these boats?
A. Yes, we have finance professionals to help you with any financing needs you might have at the most competitive interest rate available. Call the representative on the listing for help or contact Brewer Financing at 866-254-1224
AUCTION TERMINOLOGY
What is a reserve?
A. The reserve is the amount the bidding has to get to in order for the boat to sell. The reserve is not made public but the reserves are set low.
What does a minimum bid mean?
A. Minimum bid during an auction means the next bid has to go up by a certain amount. Depending on the boat it could be $100 increments or up to $2,500 increments. Each auction listing will show the next minimum bid.
What is an opening bid?
A. An opening bid is the lowest bid acceptable. Opening bids are different on each boat. You will see the opening bid number on the auction site. An accepted opening bid does not mean bidder has reached the reserve price.
What is a “up to limit bid”?
A. A up to limit bid means you can put in the highest amount you are willing to pay for the boat and the auction will automatically up your bid if you get out bid up to you limit. It’s great if you don’t want to sit around your computer all day waiting to out bid the latest t bid. Set you bid limit and we do the bidding for you up to that limit.
19. What are lots?
A. A lot is each item that is being sold at auction. Each boat is a lot.
What does a reserve mean?
A. A reserve is the minimum amount the boat will sell for. Reserve prices are not published.
Why is Brewer Yacht Sales running auctions?
A. We have been approached by lending institutions, customers and boat yards to help sell boats in a different manner. Because of the many locations we have we can offer many different boats in many different markets. The boats up for auction represent an outstanding value in today’s market, in most cases these boats will sell for substantially less than current market pricing
Who owns these boats and are they sold free and clear of any liens or outstanding bills?
A. The boats could be owned by individuals, corporations, banks, boat yards or whomever. All boats will pass to the winning bidder with a clear title and bill of sale with no liens or encumbrances.
Where are the boats located?
A. Boats are located in many different places. Each listing will tell you what state the boat is in. Contact the representative on the listing and they can give you the details.
Are these boats hurricane damaged or owned by insurance companies?
A. No. We don’t deal in damaged or salvaged boats.
TERMS AND CONDITIONS OF ONLINE AUCTION SALE
Any person participating in the auction shall be bound by the following terms and conditions. There are no representations, warranties, terms, conditions, undertakings or collateral agreements except as herein below provided. All buyers acknowledge and accept with their registration for the auction the terms and conditions of the sale as stated on this website and the terms and conditions of the Yacht Brokers Association of America Yacht Purchase and Sale Agreement.
RESERVE: All items will have a reserve as well as a minimum opening bid. The reserve amount is not made public. At the close of the auction the highest bid over the reserve wins the auction on that item.
INSPECTION:Buyer hereby acknowledges that Buyer has inspected, or has had the opportunity to inspect, all of the items upon which Buyer will be bidding and/or does purchase. Although inspection is not mandatory it is highly recommended.
BIDDING: This auction includes a staggered and soft close. A "soft" close means that if a lot bid is submitted and confirmed during the last minute before bidding closes, the closing time will be extended one minute on that item. This will continue until a full minute passes without a new bid on that lot. Please note the closing time on each lot. No bidder may revoke his or her bid.
Your bid is a binding contract. Please don't bid if you can't pay for the item. Do not ask us to cancel your bid after the auction closes. You are responsible for your bids. Brewer Yacht Sales Inc. reserves the right to refuse any applicant the privilege of bidding and may revoke such privilege at any time.
PAYMENT: A 10% deposit is required within 2 days of the close of the auction. All payments shall be by way of certified check or wire transfer, all checks are to be made out to BREWER YACHT SALES, INC, and wiring instructions are available upon request. All bidding and invoicing will be in US Dollars ($). A purchase and sale agreement will be sent out at the close of the auction outlining conditions of the sale. The buyer may have the boat surveyed at their expense as well as secure financing within the dates of the purchase and sale agreement. The purchase and sale agreement is available for review at anytime before or during the auction. Contact the name in the details page of the lot and one will be sent to you.
TAXES: Taxes arising on a sale shall be paid by the purchaser if applicable.
TITLE: Title to the lots purchased shall not pass until payment in full of the purchase price has been received and cleared and any and all liens have been satisfied. It is understood that some states do not have title documents for boats; therefore, the Yacht Brokers Association of America Purchase and Sale Agreement along with a notarized Bill of Sale constitute satisfactory transfer of ownership documentation.
All risk of loss shall pass to the purchaser at the time of payment and the auctioneer shall have no further liability to the purchaser or seller, including without limitation, any damages for loss of profits.
No purchaser may assign, transfer or dispose of his rights in any article purchased before he has paid the purchase price in full.
TIMING: Time will be of the essence. If a purchaser fails to make payment or remove goods based on the terms and conditions of this website and the terms and conditions of the YBAA Purchase and Sales Agreement, Brewer Yacht Sales, Inc. reserves the right to resell the article purchased and the purchaser shall be liable for the shortfall and all costs and expenses, including but not limited to interest rates (a minimum of 1.5% per month or 18% per annum), legal fees, moving and storage and any commissions incurred in such resale.
REMOVAL: No article or inventory thereof shall be removed unless paid in full. All articles purchased shall be removed by the dates and within the terms and conditions in the YBAA Purchase and Sales agreement. The purchaser shall be responsible for all costs associated with the removal and shall be liable for any damage, including without limitation, any environmental damage, caused during or as a result of the removal. Purchasers shall comply with all environmental laws and regulations and all requirements established by the auctioneer for the removal of articles, including requirements as to bonding of movers.
Removal of sold article is the sole responsibility of the buyer. Removal may not begin until payment has been made in full. All use of forklifts, cranes, etc whether performed by the buyer or a contractor, must present a certificate of insurance for $3,000,000.00 naming Brewer Yacht Sales, Inc and Brewer Yacht Yards as the insured.
All items are sold "As is, where is". The buyer is responsible for all costs associated with taking possession of an item as stated in the YBAA Purchase and Sales Agreement.
DISCLAIMER: ALL SALES ARE FINAL, ON AN "AS IS – WHERE IS", "IN PLACE", "WITH ALL FAULTS" BASIS WITH NO CONDITIONS OR WARRANTIES WHETHER EXPRESSED, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OR CONDITIONS AS TO TITLE, DESCRIPTION, FITNESS FOR PURPOSE, QUANTITY, QUALITY, MERCHANTABILITY, STATE, CONDITION, LOCATION OR OTHERWISE. NO SALE SHALL BE INVALIDATED AND THE AUCTIONEER SHALL HAVE NO LIABILITY FOR A MISDESCRIPTION OF ANY ARTICLE OR LOT WHETHER CONTAINED IN A CATALOGUE, ADVERTISEMENT OR OTHERWISE. DESCRIPTIONS HAVE BEEN PREPARED FOR GUIDE PURPOSES ONLY AND SHALL NOT BE RELIED UPON BY THE PURCHASER FOR ACCURACY OR COMPLETENESS. BY SUBMITTING A BID, PURCHASERS SHALL BE DEEMED TO HAVE RELIED ENTIRELY UPON THEIR OWN INSPECTIONS AND INVESTIGATIONS.
INDEMNIFICATION: The buyer hereby assumes and does agree to indemnify and hold the auctioneer (Selling Agent) and seller harmless from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have been caused by or during removal or use of item(s) purchased, or any other claim regarding the use of that asset as purchased.
This sales transaction shall be governed by and construed in accordance with the local laws of the state of Connecticut, USA and in accordance with the Rules of the American Arbitration Association then in force and shall be held in the city and state of the Selling Agent’s office. If any provision of these terms and conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of the terms & conditions shall remain in full force and effect as well as the terms and conditions of the Yacht Brokers Association of America Purchase and Sale Agreement as if such provisions had not been included.
Brewer Yacht Sales Inc. reserves the right to correct any mistakes or typographical errors made by it or in its behalf in any of its documents, without the ability of deriving right from the corrected announcements.
In the event of a computer system overload, please stay with the auction as we will attempt to correct the situation as soon as possible. Brewer Yacht Sales Inc. retains the right to reopen the bidding.
